These terms apply when you download PWSpeed, activate a license key or buy a subscription. You accept them when you tick the box in the license request form; we record the date and the version you accepted. Please read them together with the privacy policy and the refund policy.
1. Who we are
PWSpeed is a project of Ploy Web Studio, which makes and sells it. Seller: Ploy Web Studio, sole proprietorship of Fabrizio Bestoso, Strada Piangrande 7, 17051 Andora (SV), Italy. VAT number IT01826400093.
General contact: info@pwspeed.com. Support: support@pwspeed.com.
2. What these terms cover
The PWSpeed WordPress plugin, the license keys that unlock its Pro features, the updates we publish and the license server at license.pwspeed.com that the plugin talks to.
3. The software and the GPL
The PWSpeed plugin is free software, released under the GNU General Public License, version 2 or later. Nothing in these terms limits the rights the GPL gives you over the code.
What a license gives you is a service: a key that activates the Pro features through our license server, automatic updates for the licensed sites, and support. The Free plan needs no key and includes updates.
4. Plans and sites
Each license covers the number of production sites shown in its plan. Staging, development and local copies of a licensed site are included and do not count.
To move a license to another domain, deactivate it on the old site (PWSpeed → License) and activate it on the new one.
5. The launch offer
For the launch, Pro licenses are free and expire on 31 March 2027. When a free launch license expires, the site switches to the Free plan: it keeps working, and the Pro settings stay saved for when a paid license is activated.
We may stop issuing new free licenses earlier. Licenses already issued stay valid until 31 March 2027.
6. Buying a subscription
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Prices are shown at checkout with the taxes that apply in your country. A subscription renews automatically at the end of each period until you cancel it. You can cancel at any time from the link in your Paddle receipt or by writing to us: the license stays active until the end of the period you paid for.
If we change the price of a plan, we tell existing customers by email at least 30 days before their next renewal.
7. When a license expires
After the expiry date there are 14 days of grace. Then the Pro features switch off and the site carries on with the Free plan. Your settings stay saved, and updates released before the expiry date remain available.
8. Fair use
Please do not publish or share your license key, try to get around the license checks of our server, or send it automated traffic beyond what the plugin does on its own.
Agencies may use their licenses on their clients’ sites. Reselling license keys needs our written agreement.
9. Cloudflare and other services
PWSpeed works with your own Cloudflare account and, if you turn them on, with Google PageSpeed Insights and IndexNow. Those services have their own terms and, for Cloudflare, their own prices. You are responsible for your accounts with them and for what the plugin does there on your instruction.
10. Your site
PWSpeed changes how your pages are built and served. Keep regular backups and, for large changes, try them on a staging copy first. You remain responsible for the content of your site and for its compliance with the law, including towards your own visitors.
11. Warranty and liability
We work hard to make PWSpeed reliable, but the software and the license server are provided “as is”, without warranties beyond those required by law.
As far as the law allows, we are not liable for indirect damage, lost profit or lost data. Our total liability is limited to what you paid us in the 12 months before the event.
These limits do not apply to damage caused by wilful misconduct or gross negligence, or where the law does not allow them, and they do not reduce the rights you have as a consumer.
12. Consumers
If you buy as a consumer in the European Union, you keep all the rights that consumer law gives you, including the right of withdrawal described in the refund policy.
13. Revoking a license
We may revoke a license that is used in serious breach of these terms, for example a key published online. Where possible we write to you first and give you time to fix the problem.
14. Changes to these terms
We may update these terms. For important changes we email customers at least 30 days in advance, and the new terms apply from the next renewal. The date at the top shows the current version.
15. Law and courts
These terms are governed by Italian law. If you are a consumer, the courts of the place where you live have jurisdiction, and you keep the protection of the mandatory rules of your country. For businesses, the court of Savona, Italy, has jurisdiction.
